Terms of Service

These Terms of Service ("Terms") are an agreement between you ("you", "your") and BeCleva ApS, CVR 46636538, Vejlevej 86, 6000 Kolding, Danmark ("BeCleva", "we", "us", or "our"). The service brand name is BeCleva. Questions: support@becleva.com.

1. Acceptance of terms

By creating an account, paying for Premium, or otherwise using BeCleva, you accept these Terms. If you do not accept the Terms, you must not use the service.

If there is a conflict between the Danish and English versions, the Danish version prevails for users in Denmark.

2. Service description

BeCleva is a digital budgeting and personal-finance application that helps you track income, expenses, savings, subscriptions, receipts and related overviews. The service may be offered in free and Premium variants. When bank integration is enabled, you may optionally connect banks via Enable Banking (AISP) as described in section 9. Features may change, expand or be limited over time.

BeCleva is not a bank, payment institution, investment adviser, tax adviser or insurance intermediary. We do not execute payment transactions on your behalf (other than facilitating your Premium subscription via Stripe), and we do not hold or manage your money.

From time to time we may run a launch/beta mode where Premium features are temporarily available without payment. That does not change these Terms for paid subscriptions when billing is enabled.

3. Age and eligibility

You must be at least 18 (or the age of majority in your country) to create an account and enter a Premium agreement. If you are under 18, you may only use the service with parental or guardian consent where the law allows.

You represent that the information you provide is accurate and that you are entitled to use the service.

4. User accounts

You are responsible for maintaining the security of your account and password, and for all activity under your account. You must not share your account or allow unauthorised access.

Notify us promptly at support@becleva.com if you suspect unauthorised use. We may require verification before assisting with account access.

5. Your content and data

You retain ownership of the content and data you enter or import (e.g. budgets, expenses, receipt images and notes), to the extent permitted by law.

You grant us a limited, worldwide, non-exclusive licence to host, process, display and back up your content solely to provide, maintain and improve the service — including via our processors as described in the privacy policy.

You are responsible for having the right to upload and process the content you put into BeCleva. We do not claim ownership of your financial data.

6. Payment and subscription (Premium)

Premium is offered as a subscription (typically monthly or yearly), paid through Stripe. Prices, currency and period are shown before purchase in the app or on the pricing page. Card payments are handled by Stripe; we do not store full card numbers.

The subscription renews automatically for the selected period unless you cancel before the renewal date via the Stripe Customer Portal, in-app subscription settings, or by contacting us. Cancellation takes effect at the end of the already paid period; you keep Premium access until then unless otherwise agreed.

We may change prices with reasonable notice (e.g. by email or in the app) before the next renewal. Continuing the subscription after the change takes effect means acceptance of the new price; otherwise you may cancel before renewal.

In addition to statutory rights, we offer a commercial 14-day money-back guarantee from the first payment for a new Premium subscription. No refunds after 14 days unless there are material technical issues on our side, or the law requires otherwise. Contact support@becleva.com to request a refund under the guarantee.

7. Right of withdrawal (consumers)

If you are a consumer in the EU/EEA/Denmark, you generally have a 14-day right of withdrawal when purchasing digital services at a distance, under applicable consumer law.

When you purchase Premium and request that delivery start immediately (or access is activated right after payment), and you expressly agree that the withdrawal right is lost once performance has begun, the withdrawal right may be limited or lost for the commenced digital service — to the extent permitted by law.

Our 14-day money-back guarantee (section 6) applies regardless of the above, unless you have already received a full refund under the statutory withdrawal right. To exercise withdrawal or the guarantee, email support@becleva.com with your account email and purchase date.

Nothing in these Terms limits your mandatory consumer rights.

8. AI features

Certain features (often Premium) may use artificial intelligence via our secure backend — e.g. automatic categorisation of transactions or file imports, receipt scanning (image/OCR), and financial insights or assistant features.

AI processing is assistive. Output is indicative, may contain errors and does not constitute financial, legal or tax advice. We do not make solely automated decisions with legal or similarly significant effects concerning you (GDPR Art. 22). You can generally correct AI-suggested categories manually and should verify amounts and suggestions before making decisions.

For categorisation and similar text features we typically send only what is necessary — e.g. transaction descriptions and amounts — not your full name, email or bank login credentials. For receipt scanning, relevant image or text excerpts may be sent. Processing is carried out by our AI provider (currently OpenAI) and may involve transfers outside the EU/EEA, protected by the EU Commission’s standard contractual clauses (SCCs), as described in the privacy policy. Data is used solely to deliver the feature you activated.

9. Bank connection (when enabled)

When bank integration is enabled and you choose to connect a bank, account information is obtained via Enable Banking Oy ("Enable Banking"), a regulated account information service provider (AISP) under PSD2/open banking. BeCleva is not itself a bank or an AISP.

The explicit PSD2 consent to retrieve bank data is given to Enable Banking. You authorise access with your bank (typically via MitID or the bank’s own secure login). Enable Banking then forwards relevant account and transaction data to us so we can provide the service. We have read-only access to the data forwarded for budgeting and overview purposes and cannot move money or change anything on your accounts.

We do not store your bank login credentials, MitID codes or bank passwords. Any technical tokens needed for synchronisation are handled via Enable Banking and our secure backend under applicable rules.

The bank connection typically must be renewed about every 180 days (or more often if your bank requires it), which means logging in with your bank again. You can revoke access via the app settings (where supported), via Enable Banking or with your bank. Revocation typically stops new data; already synchronised data is handled under the privacy policy and account deletion.

The feature may be limited to approved users or countries during rollout. We are not liable for the bank’s or Enable Banking’s errors, downtime or refused connections, except to the extent mandatory law requires otherwise.

10. Usage restrictions

You must not: (a) use the service for illegal purposes; (b) attempt to hack, bypass security or unreasonably burden the service; (c) copy, reverse-engineer or resell the service except where mandatory law allows; (d) spam or send malicious content; (e) misuse AI or import features to process others' data without a lawful basis; (f) create accounts in an automated or large-scale way without our written permission.

11. Intellectual property

All content on BeCleva, including design, logos, trademarks and software (excluding your own user content), is protected by copyright and belongs to BeCleva or its licensors. You must not copy, modify or distribute it without permission, except where mandatory law gives you that right.

12. Disclaimer and limitation of liability

BeCleva is a budgeting and planning tool and does not constitute financial, investment, tax or legal advice. Content, calculations and any AI suggestions are for informational purposes only. Nothing in the service should be interpreted as a recommendation to buy, sell or dispose of securities, loans, insurance or other financial products.

The service is provided "as is" and "as available". We do not warrant completeness, timeliness or accuracy of data or calculations, and we do not guarantee uninterrupted, error-free or fully secure operation. You use the service at your own risk and should verify important figures and decisions yourself and seek professional advice where appropriate.

To the extent permitted by law, we are not liable for indirect loss, consequential damage, lost profits, data loss or loss arising from reliance on calculations or AI output. Our aggregate liability for claims arising out of or in connection with the service in any 12-month period is limited to the amount you paid us for Premium in that period (or DKK 500 if you have not paid).

Nothing in these Terms limits liability for wilful misconduct, gross negligence, personal injury or other matters that cannot lawfully be excluded or limited towards consumers. Your mandatory rights under Danish and EU consumer law remain unchanged.

13. Termination and suspension

You may delete your account at any time in settings and cancel Premium as described in section 6.

We reserve the right to suspend or terminate your account if you materially breach the Terms, abuse the service, create a security risk, or if we are required to do so by law. On termination your access to content may end, subject to your rights to data export and deletion under the privacy policy and the GDPR.

14. Changes to the terms

We may update these Terms. For material changes that affect your rights or obligations, we will notify you by email and/or in the application at least 30 days before they take effect, unless faster effect is required by law or security.

If you do not accept material changes, you may cancel the subscription and/or delete your account before they take effect. Continued use after the effective date means acceptance of the updated Terms, subject to mandatory consumer rights. The "Last updated" date changes when the Terms are revised.

15. Force majeure

Events beyond our reasonable control — including natural disasters, strikes, power outages, major cyberattacks, regulatory orders or failure of critical subcontractors — may cause delays or temporary limitations. We will endeavour to mitigate effects and resume normal operation. This does not limit your rights under mandatory consumer law in case of material or prolonged non-performance.

16. Governing law and disputes

These Terms are governed by Danish law, without regard to conflict-of-law rules that would lead to another country's law.

If you are a consumer, you may bring complaints via Nævnenes Hus / the Danish Consumer Complaints Board (www.forbrug.dk / www.naevneneshus.dk) or use the EU Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. You may complain to the Danish Consumer Ombudsman about unfair terms or marketing (www.forbrugerombudsmanden.dk). Privacy complaints: Datatilsynet (www.datatilsynet.dk). You may also bring proceedings in the courts of your country of residence to the extent mandatory consumer law gives you that right.

If you are a business user, disputes shall be resolved by the Danish courts with venue at our home court, unless otherwise mandatorily required.

17. Personal data

Processing of personal data is described in our privacy policy, which fulfils our GDPR information obligations. The privacy policy is available on the same website/app as these Terms.
